TERMS AND CONDITIONS for Half-Day and Full-Day Tours
ACCEPTANCE: Deposit or Payment on your booking constitutes your acceptance of these Terms and Conditions, which are subject to change without notice.
PAYMENT: Full payment is due at the time of booking. Late or nonpayment may cause automatic cancellation of your booking.
Upon booking: Kush Tourism LLC requires full payment upon booking.
21 days or more before the tour/event date. Any change or cancellation, including a rescheduling of the tour/event, will incur a $25 per person fee.
5-20 days before the tour/event date. Any change, including a rescheduling of the tour/event, will incur a fee equal to 25% of the total booking amount.
*Any cancellation will incur a fee equal to 50% of the total booking amount.*
Within 4 days of the tour/event date. Any change, including a rescheduling of the tour/event, will incur a fee equal to 50% of the total booking amount.
*No refunds given for cancellation.
*Please note: Change and cancellation fees do not include penalties incurred by third parties. Other cancellation fees or refunds for customer cancellation are at the discretion of the hotels, tour operators, caterers, rental car agencies and other Service Providers with which Kush Tourism LLC has reserved on the customer’s behalf for travel and tour related services. Insurance purchases are always non-refundable.
WE STRONGLY RECOMMEND THE PURCHASE OF TRAVEL INSURANCE to offset penalties caused by unforeseen events.
INSURANCE: Travel insurance can be purchased to cover penalty costs in the event you need to cancel or change your travel plans (subject to approval of claim by the insurer). It also can provide medical and emergency assistance protection as well as some loss and delay coverage.
VALIDITY/CHANGES: Your itinerary contains information believed to be accurate at the time of publication. Kush Tourism LLC reserves the right to modify an itinerary or substitute tour components and inclusions without prior notice.
QUOTES: Unless guaranteed in writing with a specific expiration date, quotes from our office are subject to change until full payment is made.
CHILDREN: Children are not allowed to participate in Kush Tours. All tours and activities are 21+, and Deposit or Payment on your booking constitutes that you are over the age of 21.
PASSPORTS/ID: All travelers are required to carry valid identification at all times. Foreign travelers are required, to hold a valid Passport. Additional Travel Documents, such as Visas, may be required depending upon the countries to be visited and the citizenship of the traveler. It is the sole responsibility of each traveler to ensure that he or she meets the Travel and Immigration requirements of their country of citizenship and those of the countries to be visited. Kush Tourism LLC LLC will not be held liable or responsible in any way for any traveler’s failure to obtain Travel Documentation necessary for their trip.
ENVIRONMENT & FACILITIES: Our clients always maintain a situational awareness during tours. Move slowly and consciously when navigating the facilities which will be fully operational. Avoid becoming intoxicated. Do not touch or photograph any products, rooms, or equipment without prior approval. Stay on the trail. Shore side, refill all holes and return large rocks to their original positions.
ACKNOWLEDGEMENT OF RISK: Although Kush Tourism LLC has taken reasonable steps to provide appropriate equipment and skilled guides in order for guests to enjoy an activity for which they may not be skilled, this activity is not without risk. If you do book travel with us, you therefore are acknowledging risks which are inherent in each activity and cannot be eliminated without destroying the unique character of the activity. These inherent risks are some of the same elements that contribute to the unique character of this activity and can be the cause of loss or damage to my equipment, or accidental injury, illness, or in extreme cases, permanent trauma or death. Kush Tourism LLC does not want to frighten guests or reduce enthusiasm for this activity, but believes it is important for each guest to be made aware in advance what to expect and to be informed of the inherent risks. The following describes some, but not all, of those risks:
Bodily discomfort in the form of exposure to cold and wet conditions that may, in extreme cases, lead to hypothermia.
Physical exertion that may induce cardiopulmonary distress, including but not limited to: asthma, fatigue, myocardial infarction (heart attack).
Falling due to instability of road and/or misuse of footwear that may result in bodily injuries such as sprains, strains and broken bones.
Bodily injury due to unexpected natural disturbances.
Any hazards related to driving to and from activity location (seat belts must be worn).
This waiver will be presented by the guide and all participants must agree to the following and sign before the start of the escape.
I am aware that this activity entails risks of injury or death to any participant. I understand the description of these inherent risks is not complete and that other unknown or unanticipated inherent risks may result in injury or death. I agree to assume and accept full responsibility for the inherent risks identified herein and those inherent risks not specifically identified. My participation in this activity is purely voluntary, and I elect to participate in spite of and with full knowledge of the inherent risks. I acknowledge that engaging in this activity may require a degree of skill and knowledge and that I have responsibilities as a participant. I acknowledge that the staff of Kush Tourism LLC has been available to more fully explain to me the nature and physical demands of this activity and the inherent risks, hazards, and dangers associated with this activity. I certify that I am fully capable of participating in this activity. Therefore, I assume and accept full responsibility for myself, including all minor children in my care, custody, and control, for bodily injury, death or loss of personal property and expenses as a result of those inherent risks and dangers identified herein and those inherent risks and dangers not specifically identified, and as a result of my negligence in participating in this activity.
