Can I get a DUI from driving after smoking weed in Oregon? How do they know if your high, and what determines if you’re too high to drive?

Yes, you can get a DUI if you are caught driving under the influence of marijuana in Illinois, just like any other controlled substance. If the officer believes you are under the influence of marijuana they will administer a field sobriety test which will check and monitor your behaviors. If you fail this test you will be arrested and charged with a DUI or some equivalent. Marijuana is treated roughly the same as alcohol.

Can you get a dui for driving under the influence by smoking weed in Oregon? Yes, you can. You must be very careful if you have been smoking weed in oregon. The police can and will charge you with driving under the influence if they suspect that you are under the influence of pot. They will use the same parameters to determine if you are high, that are used for drinking. Appearance and behaviour, there is a wide range of factors.

According to Oregon state law, ANY amount of marijuana ingested while or before driving will result in a driving under the influence charge (Or. Rev. Stat. Ann. § 813.010.). How high you are would need to be estimated by the responding officer, who may try to bring you to a hospital for a drug test. Other than finding drugs in your car, there is no current way to tell immediately if someone is high on marijuana
