While New York has plenty of Marijuana users, and the product is readily available, it is legal only for certain medical conditions. Cannabis has been decriminalized, however, and first offense fines for less than 25 grams start at $100. Bigger fines are possible if the use of Cannabis is displayed in public view. But lots of people in New York use marijuana, especially in New York City, and police resources are usually directed at more serious crimes.

New York state does not distinguish between travelers and locals when it comes to applying the law. It is safe to assume that the laws are the same for both travelers and locals. Please keep in mind though that while New York state has legalized the use of marijuana for only medicinal use in the case of seriously ill patients. It is currently still illegal to use marijuana in New York for recreational purposes.

The best advice we can give for tourists looking to partake in the cannabis culture is discretion. It’s best to keep your marijuana use out of public areas, but if you must smoke out in the open, a discreet vape pen is your best option.
