Can I get a DUI from driving after smoking weed in New York? How do they know if your high, and what determines if you’re too high to drive?

Yes you can get a DUI. It is illegal to drive under the influence of any drug including marijuana in the state of New York. Any amount of marijuana detected in your blood or urine after a test could lead to a charge of drugged driving. I suggest you do not risk it.

Yes you can receive a DUI in New York from being high on Marijuana. Police officers are trained to detect drivers that may be impaired. They can either pull you over after determining impairment, or if you are going through a check point and are obviously impaired to the officer you will be stopped. You’ll be asked to do a physical test to determine impairment. If you are thought to be impaired you’ll have to take a urine or blood test to determine THC levels. If you refuse your license will be suspended for a year.

Yes, you can get a DUI if you are caught driving under the influence of in New York, just like any other controlled substance. If the officer believes you are under the influence of marijuana they will administer a field sobriety test which will check and monitor your behaviors. If you fail this test you will be arrested and charged with a DUI or some equivalent. Marijuana is treated roughly the same as alcohol.
